§1 Preliminary arrangements

1. Online store operating at the address of antiqfun.com, is run by:

2. These regulations are addressed to Consumers and specify the terms and conditions and procedure for concluding a Distance Selling Agreement with the Consumer  through the Store.

§2 Definitions

1. Consumer – a physical person concluding an agreement with the Seller as part of the Store, the subject of which is not directly related to its business or professional activity.

2. Seller – a civil partnership described in § 1 of these regulations.

3. Client – any entity making purchases through the Store.

4. Store - online store run by the Seller at the online address antiqfun.com.

5. Contract concluded at a distance - an agreement concluded with the Client as part of an organized system of concluding distance contracts (as part of the Store), without simultaneous physical presence of parties, with the exclusive use of one or more means of distance communication, inclusive up to the conclusion of the contract.

6. Regulation – present regulation of the Store.

7. Order – customers declaration of the will submitted through the Order Form and aimed directly at the conclusion of the Product or Products Sales Agreement with the Seller.

8. Account – customer account in the Store where are collected data provided by the Client and information about orders placed by him in the store.

9. Registration form – form available in Store allowing the creation of an Account.

10. Order form - an interactive form available in the Store that allows placing an Order, in particular by adding Products to the Shopping Basket and defining the terms of the Sales Agreement, including the method of delivery and payment.

11. Shopping Basket – an element of the Store's software in which are shown the Products selected for purchase by the Customer and it is also possible to determine and modify the given Order, in particular the quantity of products.

12. Product – a movable item available in the Store being the subject of the Sales Agreement between the Customer and the Seller.

13. Sale Agreement – Product sales contract being concluded or concluded between the Customer and the Seller through the Online Store.

5. The Customer may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.

6. The Customer can communicate by phone with the Seller in the following hours:
Monday to Friday: 11:00 - 18:00
Saturday: 11:00 - 14:00

§4 Technical requirements

To use the Store, including viewing the Store's assortment and placing orders for Products, you will need:
a) end device with access to the Internet and a web browser: Firefox, Chrome, Opera, Safari or Internet Explorer in version 9 or higher.
b) active e-mail account (e-mail),
c) JavaScript enabled and acceptance of cookie files in the web browser.

§5 General information

1. The Seller, in the widest extent permitted by the law, is not liable for any discontinuity including interruptions in the functioning of the Store caused by force majeure, unauthorized activity of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.

2. Browsing the Stores assortment does not require creating an Account. Customer can place orders for Products offered by the Store either after creating an Account in accordance with the provisions of §6 of the Regulations or by providing the necessary personal and address data enabling execution of the order without creating an Account.

3. Prices presented in the Store are given in PLN and are gross prices (including VAT – value-added tax).

4. The final amount to be paid by the Customer consists of the price of the Product and the cost of delivery (including fees for transport, delivery and postal services), that the Customer is informed on the Store's website when placing Order and when expressing the will to be bound by the Sales Agreement.

§6 Creating an Account in the Store

1. To create an Account in the Store, the Registration Form must be completed. It is necessary to provide the following data: name, surname, e-mail address, telephone number, address of residence.

2. Creating an Account in the Store is free of charge.

3. Logging in to the Account is done by entering the login and password set in the Registration Form.

4. The Customer may at any time, without giving any reason and without incurring any fees, remove the Account by sending an appropriate request to the Seller, in particular through electronic mail or in writing to the addresses provided in §3.

§7 Rules for placing orders

In order to place an Order:

1. log in to the Store (optional);

2. select the Product being the subject of the Order and then click “Add to Basket” (or equivalent);

3. log in or use the option of placing an Order without registration;

4. if the possibility of placing an Order without registration has been chosen - fill out the Order Form by entering the data of the order recipient and the address where the Product delivery is to be made, choose the type of shipment (method of Product delivery), enter the invoice data if differs from the recipient's details,

5. click the "Order and pay" button and confirm the order by clicking the link sent in the email,

6. choose one of the available payment methods and depending on the method of payment, pay for the order within a specified time, in accordance with the provisions of §9 point 3.

§ 8 Offered delivery methods and payments

1. The Customer may choose the following methods of delivery or collection of the ordered Product:
a) Courier shipment, parcel labelled cash on delivery

2. The Customer can use the following payment methods:
a) Payment after the receipt of the Products.
b) Payment on delivery
c) Payment by bank transfer to the Seller’s account
d) Electronic payments
e) Payment by credit card.

§ 9 Execution of a sales contract

1. Conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed the Order using the Order Form in the Online Store in accordance with § 7 of the Regulations.

2. After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for implementation shall take place by sending by the Seller an e-mail message to address provided at the time of placing the Order, which contains at least the Sellers statement of receipt of the Order and its acceptance for implementation and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail by the Customer, a Sales Agreement is concluded between the Customer and the Seller.

3. If the customer chooses:

a) payment by bank transfer, electronic payment or payment by credit card, the Customer is obliged to make payment within 5 calendar days from the day of concluding the Sale Agreement - otherwise the order will be canceled.

b) payment on delivery, the Customer is obliged to make a payment on delivery.

c) payment by cash on self-pickup a delivery, the Customer is obliged to make a payment on delivery within 5 days from the date of receipt of information about the readiness of the shipment to be picked up.

4. If the Customer has chosen a delivery method other than a self-pickup, the Product will be sent by the Seller within the time specified in its description (subject to § 5 of this paragraph) in the way chosen by the Customer when placing the Order.

5. The beginning of the delivery of the Product to the Customer is assumed as follows:
a) If the Customer selects the method of payment by bank transfer, electronic payments or by credit card - from the day of crediting the Sellers bank account.
b) If the Customer selects the method of payment on delivery - from the day of concluding the Sale Agreement,

6. If the Customer selects a self-pickup of the Product, the Product will be ready for collection by the Customer within the time specified in the Product description. The Customer will be additionally informed by the Seller about the readiness of the Product by sending an appropriate e-mail to the Customer's e-mail address provided at the time of placing the Order.

7. The Product delivery takes place in ...................... (European Union, Europe, etc.)

8. The delivery of the Product to the Customer is payable, unless the Sales Agreement provides otherwise. The delivery costs of the Product (including charges for transport, delivery and postal services) are indicated to the Customer on the Online Store website in the "Delivery costs" tab and during the Order placement, including when the Customer wishes to be bound by the Sales Agreement.

9. Self-pickup of the Product by the Customer is free of charge.

§ 10 The right to renounce a contract

1. The consumer may withdraw from the Sales Agreement within 14 days without giving any reason.

2. The period of time specified in § 1 begins with the delivery of the Product to the Consumer or a person indicated by him but other than the carrier.

3. The Consumer may withdraw from the Sales Agreement, by putting request to the Seller of withdrawal from the Agreement. To comply with the withdrawal period it is sufficient for the Customer to send a request before the deadline.

4. The request may be sent by traditional mail, fax or e-mail by sending it to the Sellers e-mail address or by submitting a request on the Sellers website – the Sellers contact details are specified in § 3. The request may also be submitted on the form whose example is attached as Appendix 1 to these Regulations and an attachment to the Act of 30 May 2014 on consumer rights, however, it is not mandatory.

5. If the Consumer send a request by e-mail, the Seller shall immediately send to the Consumer the confirmation of receiving the request of withdrawal from the Agreement.

6. Effects of withdrawal from the Agreement:

a) In case of withdrawal from the Agreement concluded remotely, the Agreement is deemed not to have been concluded.

b) In case of withdrawal from the Agreement, the Seller shall return to the Consumer immediately, no later than within 14 days from the date of receipt of the Consumers request of withdrawal from the Agreement, all payments made by him, including delivery costs, except additional costs resulting from selected by the Customer method of delivery, other than the cheapest delivery method offered by the Seller.

c) The Seller will refund the payment using the same payment methods used by the Consumer in the original transaction, unless the Consumer has explicitly agreed to another solution, which will not involve any costs for him.

d) The Seller may delay the refund until receipt of the Product back.

e) The Consumer should return the Product to the Sellers address specified in following Regulations immediately, no later than 14 days from the day on which he informed the Seller about the withdrawal from the Agreement.

f) The Consumer bears direct costs of returning the Product, including cost of returning the Product, if due to its nature, the Product could not be send back in the post.

g) The Consumer is responsible only for a decrease of the value of the Product resulting from using it in a different way than it was necessary to define the nature, characteristics and functioning of the Product.

7. If, due to the nature of the Product, it can not be send back in regular mode by post, information about this as well as the costs of returning the Product, will be will be specified in the product description.

8. The right to withdraw the agreement concluded at a distance is not applied to the Consumer in relation to the Agreement:

a) in which the price depends on fluctuations on financial market, over which the Seller has no control and which may occur before the deadline to withdraw from the Agreement,

b) in which subject of the service are things than after delivery, due to the their nature, are inseparably connected with other things.

§ 11 Complaints and warranty

1. The new and used Products are covered by the Sales Agreement. The condition of each used Product is described in detail in the Stores website.

2. The Seller is obliged to provide to the Customer a product free from defects.

3. If the product purchased from the Seller has defects, the Customer has the right to make a complaint based on the provisions concerning the warranty in the Civil Code.

4. Complains should be reported in writing or by e-mail to the Sellers address provided in these Regulations.

5. The Seller will pertain to the request immediately, no later than within 14 days. If the Seller does not pertain to the request within 14 days, it is considered that the Customer's request was considered justified.

§ 12 Extrajudicial ways to handle complaints and investigating claims

1. Detailed information about the Consumer's ability to use extrajudicial ways handle complaints and investigating claims as well as the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer rights adviser, social organizations, whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection and at the following Internet addresses of the Office of Competition and Consumer Protection:

2. The consumer has the following exemplary possibilities to use extrajudicial ways to handle complaints and investigating claims:

a) The Consumer is eligible to approach to the permanent consumer court of arbitration, referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws from 2014, item 148 with later amendments), with a request to resolve the dispute arising from the Contract concluded with the Seller.

b) The Consumer is eligible to approach to the provincial inspector of Trade Inspection, according to art. 36 of the Act of 15 December 2000 about the Trade Inspection (Journal of Laws from 2014, item 148 with later amendments), with a request to initiate mediation proceedings to find an amicable solution to end the dispute between the Consumer and the Seller.

c) The Consumer can get free assistance in settling the dispute between him and the Seller, also using the free help of the district (municipal) consumer rights adviser or social organization, whose statutory tasks include consumer protection (among others the Consumer Federation, Association of Polish Consumers).

§ 13 Personal data in the Online Store

1. The Seller is the administrator of Customers personal data collected through the Online Store.

2. Customers personal data collected by the administrator through the Online Store are collected in order to implement the Sales Agreement and if the Customer agrees - also for marketing purposes.

3. The receivers of personal data of the Online Store Customers may be:

a) In the case of a Customer who uses, in the Online Store, the method of delivery by post or carrier, the Administrator provides the Customers personal data to a selected carrier or intermediary performing the shipment at the request of the Administrator.

b) In the case of a Customer who uses, in the Online Store, the method of electronic payments or payment by a card, the Administrator provides the Customers personal data to the selected entity servicing the above payments in the Online Store.

4. The customer has the right to access their data and to correct them.

5. Providing personal data is voluntary, but refusal to provide the personal data specified in the Regulations, necessary to conclude a Sales Agreement, results in the inability to conclude this contract.

§ 14 Final provisions

1. Contracts concluded through the Online Store are concluded in Polish.

2. The Seller reserves the right to make changes in the Regulations for important reasons like: changes in the law, changes of payment and delivery methods - to the extent to which these changes affect the implementation of the provisions of these Regulations. The Seller shall inform the Customer about each change at least 7 days in advance.

3. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act of the provision of electronic services; Consumer Rights Act, the Act of the Protection of Personal Data.

4. The Customer has the right to use extrajudicial ways to handle complaints and investigating claims. To this, the Customer may lodge a complaint through the EU ODR online platform at: http://ec.europa.eu/consumers/odr/.

5. Any disputes arising between the parties will be heard by the District Court for Wrocław-Śródmieście in Wrocław.
